Community - The Public Utility Lot

The Public Utility Lot (“the PUL”) has been a contentious issue for MBHA homeowners for several years.  A great deal of Board of Director time and energy has been devoted to pursuing this issue over the years but recent events have led your current Board of Directors to make the following motion extracted from the Board of Director’s December 27, 2007 minutes:

  1.   BUSINESS ARISING FROM THE MINUTES/COMMITTEE REPORTS
    1. Motion on PUL-as a courtesy to guest Don Silver this item was moved forward on the agenda for discussion.  Don Silver made his views known on why he adamantly opposes previous Board & AGM decisions on the PUL agreement with the TSL.  Lindsay reviewed the contents of his November 03, 2007 email to the Board  on the PUL to give both Silver and any Board member an opportunity to discuss each item.  At the end of the discussion Silver left the meeting, the Board was called to order and given we had a quorum  the following motion was made:

Motion:  Given the June 25, 2007 formal written objections by Don Silver, Unit 332, to the process used by MBHA to negotiate and approve the PUL agreement with the Town of Sylvan Lake, the subsequent written legal opinion obtained from Roanoak Law Office that suggests  MBHA By-Laws were not properly followed when seeking MBHA membership approval on the PUL, and the strong probability that MBHA’s current membership will never reach a broad consensus on the PUL issue I move that that the MBHA Board cease all activities or efforts to implement the PUL terms and conditions and, accordingly, the TSL be advised after the 2008 AGM that the are solely responsible for the PUL and alterations made thereon.  Moved:  Lindsay, Seconded: Taylor  Carried unanimously.

By delaying the communication to the TSL until after the AGM and by advising all MBHA homeowners of the current status in January there will be time if people want to get on the Board if they wish to pursue this in some other fashion.
